Construction problems frequently start because there is not a detailed contract of the work to be done, the related costs, time frame, contingencies and the warranty. More problems occur when there is a change in the job without a change order. Legal representation at the beginning of the job would save both contractors (including subcontractors) and property owners later expense and aggravation.
A second stage of problems occurs when there is a disagreement and the contractor, subcontractor or owner do not follow a proper legal procedure to resolve their differences.
If problems are not resolved, then the contractor or owner will usually be well served by at least an initial consultation to determine their options, what preliminary steps need to be taken and the costs and benefits involved. Frequently there are legal deadlines (e.g., mechanics lien) and practical ones (preserving evidence, getting expert opinions, moving on with ones life).
